Introduction

The app “Getreal” (“App”)is owned and operated by Getreal Entertainment Private Limited(“Company”). The Company is engaged in a business within the scope of the entertainment industry. The Company would provide and operate a digital platform either through a mobile app on iOS/Android or Website , which is designed to facilitate the engagement of performance artists (Musician, Disc Jockey, Juggler, Comedian, Poet, Dancer, Mixologist, Mentalist etc.) and users seeking to utilize their services (“Services”). Users can procure services for performances and Gigs, following a review of artists’ profiles containing their portfolio of work, including recorded videos of prior performances and engagements.

This privacy policy (“Privacy Policy”) sets out the privacy practices of the Company with respect to the usage of the App and any other platforms that may be made available to you by the Company, in the future including, but not limited to, mobile applications and electronic devices in connection with our Services.

This document is considered an electronic record and is published in accordance with the provisions of the Information Technology Act, 2000 and The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (as amended/re-enacted) made thereunder that require publishing the rules and regulations, privacy policy on an online portal of the Company. We request you to go through this Privacy Policy carefully before you decide to access the App or website and avail the Services. This electronic record is generated by a computer system and does not require any physical or digital signature.

For the purposes of this Privacy Policy, the words “us,” “we,” and “our” refer to the Company and all references to “you,” “your” or “user,” as applicable, means the person who accesses or uses the App / Website and avails the Services in any manner or capacity. Getreal App shall mean and include the mobile App and our Website.

The protection and security of your personal information is our top priority and we have taken all reasonable measures to protect the confidentiality of the user information and its transmission through the internet.

By using our Services and the App / Website or by otherwise giving us your information under the concerned Terms of Use available on the App and the Website, you agree to the terms of this Privacy Policy. You also expressly consent to our use and disclosure of your Personal Information (as defined below) in the manner prescribed under this Privacy Policy and further signify your agreement to this Privacy Policy. If you do not agree to this Privacy Policy, kindly do not use our Services and the App or share any of your information in any manner whatsoever with us.

1.1 We may collect and process information from you, through your access and use of the App and Services. We may collect and process personal information provided by you, including but not limited to any information that identifies or can be used to identify, contact, or locate you, such as your first name, last name, date of birth, gender, email id, phone number, address, project names, professional experience, Stage Name, Languages, Art forms, Bio, Tech Requirements, Calendar availability, Base location [predominant location], videos, maximum crowd size, number of shows performed, Performance and training fees], Passport/Aadhaar, social accounts (for verification purpose only) and other relevant information. We may retrieve information from such other accounts like Gmail and Facebook if you use the same to register so as to continue to interact with you and to continue providing the Services.

1.2 We may also receive data from or about the computer, mobile phone, or other devices you use to access our Platform, including when multiple users log in from the same device. This may include network and communication information, such as your IP address or phone number, and other information about things like your internet service, operating system, location, the type (including identifiers) of the device or browser you use, or the pages/hyperlinks you visit or advertisements you interact with. For example, we could request device information to improve how our Services work on your device.

1.3 When you make a booking, our payment gateway provider, Razorpay, may collect your purchase, address or billing information, including your credit card number, expiration date, CVV etc. We would be storing your account details for the limited purpose of instances where the refund is to be processed. We recommend that you go through the privacy policy and terms of use of Razorpay, and should you have any queries in this regard please reach out to Razorpay’s support team. 1.4 We may also receive information regarding the details and transaction history in connection with your use of the App / Website.

1.5 We may collect additional information at other times, including but not limited to, when you provide feedback, change your content or email preferences, respond to a survey, or communicate with us and such information will be stored, processed and/or used in accordance with the terms of this Privacy Policy and applicable laws.

1.6 We may also get information about you from other sources. For example, if you create or log into your account through any associated service, we will receive information from that service (such as your username and profile information) via the authorization procedures used by that service. The information we receive depends on which services you authorize and any options that are available.

1.7 We may use cookies, web beacons, tracking pixels, and other tracking technologies on the App to help customize the App and improve your experience.

The information that we receive from you as detailed in the paragraph above is hereinafter, collectively referred to as “Personal Information.” By sharing this Information with the Company or accessing, using, or registering to use the Services, you consent to the collection, storage, use, processing, transfer and disclosure of such Personal Information in accordance with this Privacy Policy and applicable laws.

The primary goal of the Company in collecting the Personal Information is to enable access to and use of the App and Services by you. We may use the Personal Information provided by you in the following ways:

(b) To provide access to and use of the Services;
(c) To observe and analyze usage, diagnose problems and issues, and improve and administer the quality and performance of the App and Service;
(d) To confirm your identity in order to determine your eligibility to access and use our digital platform and avail the Services;
(e) Remember the basic information provided by you for effective and efficient access to the App and Service;
(f) To notify you about any changes to the App / Website, Services, and this Privacy Policy;
(g) For the purpose of sending administrative notices, Service related alerts, marketing communications and advertisements and similar communication from time to time;
(h) For internal operations such as market research, troubleshooting, project planning, and devising strategies against fraud and other criminal activity;

(j) To disclose your Personal Information to any of our affiliates or related entities in connection with the operation and management of the App and Services in accordance with applicable laws.

2.2 Cookies and IP Address (a) Cookies are small portions of information saved by your browser onto your computer or mobile (“Cookies”). Cookies are used to record various aspects of your visit and assist us in providing you uninterrupted service. We employ tracking technologies like browser cookies, Google Webmaster, Google Analytics, web beacons, and others.
(b) We may use information collected from our Cookies to identify user behavior and to serve content and offers personalized recommendations of artists based on user’s profile and to provide user interaction derived insights to artists to enhance their profiles and offerings. We use the information to personalize your experience and in order to enhance the convenience of the users of our App and Services.
(c) Most browsers are set to accept cookies by default. You can remove or reject cookies but be aware that such action could affect the availability and functionality of the App. You may not decline web beacons. However, they can be rendered ineffective by declining all cookies or by modifying your web browser’s settings to notify you each time a cookie is tendered, permitting you to accept or decline cookies on an individual basis.
(d) You acknowledge and agree that third party service providers may use Cookies or similar technologies to collect information about your pattern of accessing and using the App and availing the Services, in order to inform, optimize, and provide advertisements based on your visits to the App and general browsing pattern and report how the third party service provider’s advertisement impressions and interactions with these impressions and services are in relation to your visits on such third party’s App.
(e) We neither have access to, nor does the Privacy Policy govern the use of Cookies or other tracking technologies that may be placed by third party service providers on the App. These parties may permit you to opt out of tailored advertisement at any time, however, to the extent advertising technology is integrated into the App and Services, you may still receive advertisements and related updates even if they or you choose to opt-out of tailored advertising. We assume no responsibility or liability whatsoever for your receipt or use of such tailored advertisements.
(f) We may use any data that is automatically captured by the cookies on our App and Services including your device name, operating system version, configuration of the application, time, and date of your use of the App and Service, IP address and other such related statistics. Every computer/mobile device connected to the internet is given a domain name and a set of numbers that serve as that computer’s or device’s IP address. When you request a page from any page within the App, our web servers automatically recognize your domain name and IP address to help us identify your location. The domain name and IP address reveal nothing personal about you other than the IP address from which you have accessed the App.

SHARING OF INFORMATION

3.1 Sharing We acknowledge the importance of information sharing for the efficacy of our platform, particularly concerning bookings and collaborative endeavors. We reserve the right to disclose pertinent information to artists, vendors, and partners as necessary to facilitate meaningful connections. Other than as mentioned elsewhere in this Privacy Policy, we may share aggregated demographic information with third parties. This is not linked to any Personal Information that can identify an individual person. We will however not be liable for transfer of any Personal Information resulting from failure of third-party service providers, cyber-attacks or terrorism or any other event beyond the Company’s control.

3.2 Consulting a. We may partner with another third party to provide certain specific services if required. When you sign-up for such services, we may share such Personal Information that is necessary for the third party to provide these services like SMS integration for account verification, password reset notification and other related services. Our contractual arrangements with such third parties restrict these parties from using Personal Information except for the explicit purpose of providing the specific services agreed to be provided by such third party. The following data may be shared for the following purposes –
i. Phone number: To deliver verification codes and notifications to the intended recipient.
ii. Message content: Only information required for verification or communication purposes.
b. We integrate the Google Places API to offer location-based services and enhance the app's functionality. When using location-based features, the following data may be shared with the Google Places API: i. Location data: Coordinates, addresses, and other location-related information necessary for providing location-based services.
Google's use of data collected through the Places API is subject to Google's Privacy Policy and Terms of Use.
c. Firebase Analytics
We use Firebase Analytics to gain insights into user behaviour and app usage. This helps us enhance the user experience and improve our services. Information collected and used are pertaining to User interactions such as clicks, navigation paths, and engagement with specific features and device information including device model, operating system, and screen resolution and Demographic information such as language settings and geographic location (country/region). Firebase Analytics data is aggregated and anonymised to protect your privacy. Individual user data is not shared with third parties.
d. Firebase Authentication
We utilize Firebase Authentication to offer secure user registration and login services. When you create an account or log in through our app, the following data may be processed:
i. Email address: Used for account verification and communication.
ii. Username and password: Used for secure login to your account.

e. Real Time Database
Our digital platform uses Firebase Realtime Database for real-time communication and data synchronization. This enables seamless interactions between users and supports dynamic content updates. The data shared through this feature is user-generated and may include messages and user-generated content shared within the app's features. Firebase's real-time database functionality ensures efficient data synchronization while maintaining appropriate security measures.
f. In addition to the foregoing, we may use Google AdWords and/or other such services to advertise on third party websites or applications. This could be in the form of an advertisement on the Google search results page, or a site in the Google Display Network. We understand that Google’s use of the DART cookie enables it to serve ads to its users based on their visit to the App and other applications or websites on the Internet. You may choose to opt out of the use of this DART cookie by visiting Google’s privacy document.

3.3 Targeted Advertising You expressly acknowledge and agree that we may also share or transfer information (including Personal Information) in relation to your browsing history, cache, IP address and domain name to third-party service providers, for the limited purpose of allowing or permitting such third-party service providers, including social media websites or applications to map similar audiences and display advertisements and notifications on websites or applications across the Internet, based on the information that is collected by us. Personal Information may also be shared or transferred to optimize and display advertisements based on your past preferences and visits to the App. We do not allow any unauthorized persons or organization to use any information that we may collect from you through this App.

3.4 Regulatory Disclosures We cooperate with government and law enforcement officials and private parties to enforce and comply with the law. Thus, we may access, use, store, transfer and disclose your information (including Personal Information), including disclosure to third parties such as government or law enforcement officials or private parties as we reasonably determine is necessary and appropriate: (i) to satisfy any applicable law, regulation, governmental requests or legal process; (ii) to protect the safety, rights, property or security of the Company, our Services, the App or any third party; (iii) to protect the safety of the public for any reason; (iv) to detect, prevent or otherwise address fraud, security or technical issues; and /or (v) to prevent or stop any activity we consider to be, or to pose a risk of being, an illegal, unethical, or legally actionable activity. Such disclosures may be carried out without notice to you.

3.5 Referrals When you e-mail/message a Service available on the App to a friend, you and your friend’s names and e-mail addresses/numbers are requested. This ensures that your friend will know that you have requested that we send them an e-mail/message. Your email and your friends’ e-mail addresses will only be used for this purpose unless permission is otherwise granted. Please note that we may use/share this information with third party services that enable us to provide this referral feature to you.

3.6 Link to Third Party Apps The App and Services may contain links which may lead you to other websites, applications and services offered by third parties. Please note that once you leave the Company’s App and Services, you will be subjected to the privacy policy of such other third parties. The linked websites, applications and services are not necessarily under our control. Please be aware that we are not responsible or liable for the privacy practices of such third parties. We encourage you to read the privacy policies of each and every such third party. If you decide to access any of the third-party websites, applications, and services, you do this entirely at your own risk.

4. SECURITY OF INFORMATION

4.1 We have put in place necessary and advanced security practices and procedures to safeguard and secure your Personal Information against unauthorized disclosure and use. We only process Personal Information in accordance with this Privacy Policy. Access to your Personal Information is limited to employees, agents, or partners and third parties, who we reasonably believe will need that information to enable the Company to provide Services to you. However, we are not responsible for the confidentiality, security, or distribution of your Personal Information by our agents, partners and third parties.

4.2 Our platform employs JSON Web Tokens (JWT) for user authentication purposes. This token-based system guarantees that access to user accounts and their associated data is restricted solely to individuals possessing valid and verified tokens.

4.3 Your data is securely stored on servers equipped with robust firewall and intrusion detection systems to thwart unauthorized access. Our server infrastructure is configured with a robust firewall system designed to safeguard against malicious attacks and unauthorized access attempts.

4.4 We utilize MongoDB as our database management system. Our MongoDB databases are equipped with robust security measures, such as stringent access controls and authentication mechanisms, to safeguard the confidentiality and integrity of stored data. The server-side application, developed using Node.js, is fortified with a robust firewall system designed to mitigate common web vulnerabilities and defend against malicious attacks.

4.5 All data transmitted between your device and our servers, as well as data stored on our servers, undergoes encryption using industry-standard encryption protocols (SSL/TLS). However, we assume no liability for any disclosure of information due to errors in transmission, unauthorised third-party access or other acts of third parties, or acts or omissions beyond our reasonable control and you agree not to hold the Company responsible for any breach of security.

4.6 We regularly perform security audits and assessments to detect and mitigate potential vulnerabilities. We perform regular internal and external security audits to ensure the protection of personal data. Internal audits are conducted by our trained personnel, while external audits may involve independent experts or authorities. These audits are designed to identify and rectify any potential vulnerabilities in our systems and processes, thereby enhancing the security and integrity of the personal data we process. We are committed to complying with the national and international requirements (wherever applicable) and safeguarding the privacy and security of your personal information."

4.7 We routinely back up your data to mitigate the risk of data loss and to guarantee data accessibility in the event of unforeseen incidents.

5. EXCLUSION

This Privacy Policy does not apply to any information other than information collected by the Company through the App and Services including such information collected in accordance with paragraph 1 above on “Collection of Information” and governed by the terms of the Terms of Use available on the App. This Privacy Policy will not apply to any information available in the public domain and unsolicited information provided by you through the App and Services or through any other means. This includes, but is not limited to, information posted on any public areas of the App. All such unsolicited information shall be deemed to be non-confidential, and we will be free to use, disclose such unsolicited information without limitation.

6. PERSONAL INFORMATION OF CHILDREN

Our digital platform is provided and accessible to individuals who are at least 18 years old and of legal age to enter into binding agreements. Minors under the age of 18, but at least 13 years old, may only use the Site with the supervision and permission of a parent or legal guardian who owns the account. Individuals under the age of 13 are not permitted to use the Site or Getreal services. We do not knowingly collect personal information from children under the age of 13.

7. RIGHT TO WITHDRAW CONSENT

The consent that you provide for the collection, use and disclosure of your Personal Information will remain valid until such time it is withdrawn by you in writing by sending an email to support@getreal.buzz. If you withdraw your consent, we will stop processing the relevant Personal Information except to the extent that we have other grounds for processing such Personal Information under applicable laws. We will respond to your request within a reasonable timeframe.

8. DATA RETENTION

We shall not retain Personal Information longer than is necessary to fulfil the purposes for which it was collected and as permitted by applicable law. Subject to applicable law, if you delete your account or withdraw your consent for the collection, use, and disclosure of your Personal Information, we may retain your Personal Information as needed to comply with our legal and regulatory obligations, resolve disputes, conclude any activities related to the deletion of an account, to investigate or prevent fraud and other inappropriate activity, to enforce our agreements, and for other business reasons.

9. RIGHT TO ACCOUNT DELETION

You may request deletion of your account at any time through the Settings > Account menus on the App. Following an account deletion request, we will delete your account and Personal Information, unless it is required to be retained due to legal or regulatory requirements. Please note that we may take time to process deletion requests, and after the account is deleted, we will not use your Personal Information for any processing unless required by us to comply with our legal obligations in accordance with this Policy.

10. RIGHT TO CORRECTION

The App allows the Users access to their Personal Information and allows them to correct, amend or delete inaccurate information. Our digital platform design is crafted to facilitate effortless management of your information while adhering to legal norms You are responsible for maintaining the accuracy of the Personal Information you submit to us, such as your contact information provided as part of account registration. We rely on you to disclose all relevant and accurate information and to inform the Company of any changes. If you wish to access, correct or update your Personal Information, you may head to the app settings and modify details like name, email, and contact number easily. We shall not be liable for the accuracy or competency of any information that you have shared with us.

11. OPT OUT PROCEDURES

You may opt-out of receiving marketing and certain other kinds of non-account related communications from the Company by clicking on the “unsubscribe” button or by sending an email to support@getreal.buzz.

12. NOTIFICATION OF CHANGES

From time to time, we may update this Privacy Policy to reflect changes to our information practices with due notice to you via the App or by email. You acknowledge that it is your responsibility to check this Privacy Policy for updates periodically. Your continued use of the App and Services following the posting of any changes to this Privacy Policy will be deemed to constitute an acceptance of those changes.

13. GRIEVANCE REDRESSAL AND GRIEVANCE OFFICER

In the event that you wish to raise a query or complaint with us, please contact our Grievance Officer (contact details set out below) who shall acknowledge your complaint within 24 (twenty four) hours from the time of receipt of such complaint. Complaints sent to the Grievance Officer must clearly indicate your name, contact details, the kind of information in relation to which the complaint is being filed and the grievance with respect to the information.
